1. Introduction
Unscammed AI LLC (“Unscammed,” “we,” “our,” or “us”) is a California-based company dedicated to helping consumers identify, report, and prevent scams using AI-powered tools. We primarily serve users in the United States and may extend services to the UK and EU.
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Business (the “Terms”) and our Privacy Policy located at https://unscammed.com/privacy . These Terms constitute a binding legal contract between you and Unscammed AI.
2. OUR SERVICES
We assist individuals and businesses affected by cybercrime through services that may include:
- Unscammy – Voice AI for scam prevention and education.(Premium Product)
- Scam Reporting Agent – Assists with generating and submitting scam reports to agencies and banks. The Premium version of this will also connect you to your bank and assist you with reporting the scam.
- Scam Sensei – Interactive scam detection training for individuals and families. (Premium product)
- Detecting and deleting and your personal information- Assist in searching for your personal data with our list of identified data brokers and deleting the information with the said data brokers.
3. Who may use the Services
You must be legally able to enter into contracts in your jurisdiction to use the Services. If you register on behalf of an organization, you confirm you are authorized to bind that organization to these Terms and that the organization will be responsible for compliance with them.
4. Accounts, registration and subscriptions
- To access certain features you must create an account and provide accurate, current information. Keep your account credentials secure and notify us immediately of any unauthorized use.
- Subscriptions (free or paid) are available as described on our site. We may approve or decline account requests in our discretion.
- Subscription plans auto-renew unless you cancel before the next billing date. You may cancel at any time from your dashboard; your paid features remain available until the end of your current billing month, after which your account moves to our free plan.
- We may offer limited discounts or promotional features at our discretion. Those offers may be time-limited and subject to additional terms.
5. What you are licensed to do
Subject to your observance of these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services during the subscription period for your internal business or personal use only. Nothing in these Terms grants you ownership of any Unscammed AI intellectual property.
6. Payments and billing
- Fees for Premium Products/ Services are stated on the Website or on order documentation.
- Monthly subscriptions are non-refundable; cancelling stops future charges. Annual subscriptions are charged for the billing months elapsed, including the month in which you cancel, and the remaining full months of the annual term are refunded automatically to your original payment method.
- Changes between business plans take effect immediately, with any price difference charged or credited on a prorated basis.
- We use third-party payment processors. You agree to the processor’s terms and recognize that Unscammed AI does not control their operation.
- We reserve the right to change prices, billing intervals, or payment methods; changes will apply to new billing periods.
7. Acceptable use and prohibited activities
You must not use the Services to:
- infringe third-party rights or break the law;
- introduce malware, disrupt our systems, or attempt to bypass security controls;
- copy, modify, or create derivative works of our services;
- harvest or scrape data from the Services for resale or competitive use;
- use the Services to provide a product or service that competes with Unscammed AI.
If we reasonably suspect misuse, we may suspend or terminate access and pursue any remedies available to us.
8. Your representations
By using the Services you represent that: (a) information you provide is accurate; (b) you have authority to provide any data you share; and (c) you will comply with applicable laws and these Terms.
9. Privacy and communications
We collect and process personal data in accordance with our Privacy Policy. You consent to receive service messages, security alerts, and other communications related to your account. You may opt out of marketing communications as described in the Privacy Policy.
10. Third-party offerings and referrals
We may make third-party products, services, or insurance available through the Services. Those are offered and administered by the third party; Unscammed AI is not the insurer, vendor, or provider unless explicitly stated. If you choose to use a third party, you do so under their terms and at your own risk.
11. No warranties
The Services are provided on an “as-is, as-available” basis. We expressly disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and noninfringement. We do not guarantee uninterrupted or error-free operation.
12. Disclaimers
Our Services provide guidance and tools to help identify and report scams. We do not guarantee recovery of lost funds. Scam Recovery Scores are estimates only. Our advice is based on the information you have provided therefore we cannot guarantee 100% accuracy we do ask you exercise your own judgement given your specific circumstances when making a decision. To the fullest extent permitted by law, Unscammed’s total liability for any claim shall not exceed the fees paid in the 12 months preceding the claim. All our reports are advisory only and may not be a true reflection of a police/FBI/FTC report. We aim to provide you with a comprehensive report which will minimise number of interactions with the governing bodies thereby streamlining the process. We do not guarantee that the bodies will respond in a timely manner.
13. Limitation of liability
To the fullest extent permitted by law, Unscammed AI (and its officers, employees, agents and partners) will not be liable for indirect, incidental, special, consequential, punitive or exemplary damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages. Our aggregate liability for claims related to these Terms will not exceed the amount of fees you actually paid to Unscammed AI for the Services during the twelve (12) months immediately preceding the event giving rise to the claim. Some jurisdictions do not permit certain limits; if local law prevents a limitation, that limit may not apply to you.
14. Indemnity
You agree to defend, indemnify and hold Unscammed AI and its affiliates harmless from liabilities, claims, losses, damages, costs and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your misuse of the Services; or (c) your violation of law or third-party rights.
15. Changes to the Services and these Terms
We may update the Services, features, and these Terms from time to time. For material changes we will make a reasonable effort to notify you (for example by email or notice on the Website). Continued use after notice constitutes acceptance of the updated Terms.
16. Dispute resolution; arbitration; small claims
If a dispute arises out of or relates to these Terms, we prefer to try to resolve it informally first — contact us at at legal@unscammed.ai. If we cannot resolve the dispute within 30 days, either party may proceed as follows:
- Arbitration: Except where prohibited by law, disputes will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration is individual — you and we each waive any right to a jury trial and to participate in a class, collective, or representative action.
- Small claims: Either party may choose to bring a qualifying claim in small claims court instead of arbitration.
- Arbitration awards are final and may be entered in any court having jurisdiction.
Arbitration-related costs will follow the AAA rules, and if you demonstrate inability to pay, we will cover costs as required to avoid arbitration being prohibitively expensive for you.
17. Termination
Either party may terminate your subscription as set out in applicable order details. We may suspend or terminate access to the Services immediately if you breach these Terms or if required by law. Termination does not relieve you of obligations incurred prior to termination (including payment obligations) or obligations intended to survive termination (e.g., sections on intellectual property, limitations of liability, indemnity).
18. Intellectual property
All intellectual property rights in the Services remain with Unscammed AI or its licensors. You may not remove proprietary notices, copy underlying code, or claim ownership of our materials. If you provide feedback or ideas, you agree that we may use them without compensation.
19. Miscellaneous
- Entire agreement: These Terms (including the Privacy Policy and any order documentation) are the complete agreement between you and Unscammed AI concerning the Services.
- Severability: If a court finds any provision invalid, the remainder of the Terms will continue in effect.
- No waiver: Failure to enforce a right is not a waiver of that right.
- Governing law and venue: These Terms are governed by the laws of the State of California, excluding its conflicts-of-law rules. Except for arbitral matters, courts located in California have exclusive jurisdiction over disputes that are not subject to arbitration.
- Electronic records: You agree that records provided electronically are enforceable and admissible as originals.
